All estimates, calculations, market ranges, and suggestions generated by this platform are preliminary, non-binding, and for informational purposes only. They are not professional advice, appraisals, or guarantees of any kind. You are solely responsible for verifying all information and making your own independent business decisions. MetroWest Scheduling accepts no liability whatsoever for any losses, damages, or consequences arising from your use of or reliance on any information provided by this platform.
1. Acceptance of Terms
By creating an account, accessing, or using MetroWest Scheduling (“the Service”, “the Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree to all of these terms, you must not use the Service. Your continued use of the Service after any modifications to these Terms constitutes acceptance of those changes.
2. Description of Service
MetroWest Scheduling provides a digital estimation and scheduling tool designed for independent painting professionals. The Service allows users to generate preliminary cost estimates based on user-provided inputs (such as job details, hourly rates, and material costs) and publicly available regional averages. The Service also offers scheduling features, PDF generation, and materials checklists.
The Service is a tool, not an advisor. It performs mathematical calculations based on the data you provide. It does not evaluate job conditions, market dynamics, client relationships, or any other factors that affect real-world pricing.
3. Estimate Disclaimer & No Reliance
You expressly acknowledge and agree that:
- All estimates, calculations, market ranges, and pricing suggestions generated by the Service are preliminary, approximate, and non-binding.
- Estimates are based solely on the information you enter and on generalized regional averages. They do not account for actual site conditions, material availability, seasonal pricing, labor market variations, client-specific requirements, or any other variable.
- Market range estimates are statistical approximations based on aggregated data and are not appraisals, recommendations, or guarantees that your pricing will be competitive or profitable.
- No estimate generated by this Service should be treated as a final quote, bid, or contract price without independent professional verification and on-site assessment.
- MetroWest Scheduling does not recommend, endorse, or guarantee any specific pricing, and you assume full responsibility for any prices you quote to customers.
4. AI & Smart Fill Disclaimer
The Service may include AI-powered features (such as “Smart Fill”) that use artificial intelligence to extract or suggest data from text you provide. You acknowledge that:
- AI-generated suggestions may contain errors, omissions, or inaccuracies.
- You are solely responsible for reviewing, verifying, and correcting any AI-generated data before using it in an estimate or quoting it to a customer.
- MetroWest Scheduling makes no representations or warranties about the accuracy, completeness, or reliability of AI-generated content.
- You agree not to hold MetroWest Scheduling liable for any errors in AI-extracted or AI-suggested data.
5. Materials & Method Checklist Disclaimer
The auto-generated materials checklist is a convenience feature only. Quantities are rough estimates based on general industry averages (e.g., ~350–400 sqft per gallon). Actual material needs will vary based on surface porosity, application method, number of coats, coverage rates, and other factors. Always verify material quantities independently before purchasing.
6. User Responsibilities
By using the Service, you represent and warrant that:
- You are a professional or business operator and are using the Service for legitimate business purposes.
- You are solely responsible for the accuracy of all data you input, including but not limited to: job details, hourly rates, material markups, customer information, and scope of work.
- You will independently verify all estimates through professional on-site assessment before presenting them to clients or relying on them for business decisions.
- You understand that the Service is a tool to assist your workflow, not a substitute for professional judgment, experience, or on-site evaluation.
- You will not present estimates to customers as guaranteed or final prices without your own independent review and adjustment.
- You are responsible for complying with all applicable local, state, and federal laws and regulations, including licensing requirements, tax obligations, and consumer protection laws.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- MetroWest Scheduling, its owners, operators, affiliates, employees, and agents (“Released Parties”) shall NOT be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to: loss of profits, loss of revenue, loss of business, loss of customers, loss of data, loss of goodwill, or any other commercial damages or losses.
- Released Parties shall not be liable for any damages arising from: (a) your use of or reliance on any estimate, calculation, market range, or suggestion generated by the Service; (b) inaccurate, incomplete, or erroneous data or inputs provided by you; (c) any business decision you make based on information from the Service; (d) any pricing you quote to your customers; (e) any job outcome, customer dispute, or financial result.
- In no event shall the total liability of the Released Parties exceed the amount you paid to MetroWest Scheduling in the twelve (12) months preceding the claim, or $50 USD, whichever is less.
- These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if the Released Parties have been advised of the possibility of such damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless MetroWest Scheduling and its Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney’s fees) arising from or related to:
- Your use of the Service or any estimates generated through it.
- Any pricing, quotes, or representations you make to third parties based on information from the Service.
- Your violation of these Terms or any applicable law.
- Any dispute between you and your customers or clients.
9. No Warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE.
MetroWest Scheduling does not warrant that: (a) the Service will meet your specific requirements; (b) the Service will be error-free, secure, or uninterrupted; (c) any estimates or calculations will be accurate or reliable; (d) the quality of any information obtained through the Service will meet your expectations.
10. Intellectual Property
All content, branding, software, algorithms, and intellectual property associated with MetroWest Scheduling are the exclusive property of MetroWest Scheduling and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service.
11. Account & Access
The free demo is limited to 2 uses per email address. Abuse of the demo system, including using multiple emails to circumvent limits, may result in immediate access restrictions. We reserve the right to suspend or terminate accounts that violate these terms or misuse the Service.
12. Pricing & Billing
Current Plan Structure:
- Free Trial: New accounts receive a 90-day free trial with full access to all features, including unlimited quote generation, branded PDFs, scheduling, and AI Smart Fill.
- Paid Plan: After the trial period, continued access to the Service requires a subscription at $20 per month.
- No credit card required to start your free trial.
- Cancel anytime. There are no long-term contracts or cancellation fees.
- We reserve the right to modify pricing with 30 days' notice. Price changes will not affect your current billing cycle.
13. Account Deletion
You may request deletion of your account at any time through your Account page. Upon receiving your request:
- Your account will enter a 30-day review period during which you can still access and use the Service normally.
- You may cancel your deletion request at any time during the review period from your Account page.
- After the 30-day review period, an administrator will process the deletion. Once processed, all your data — including estimates, quotes, customer information, business profile, uploaded files, and PDFs — will be permanently and irreversibly removed.
- We may retain certain anonymized, aggregated data for analytical purposes that cannot be used to identify you.
- Account deletion does not affect any outstanding billing obligations incurred before the deletion request.

14. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be posted on this page with an updated date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.
15. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Massachusetts. You consent to the personal jurisdiction of such courts.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
